Terms of Use for CabRank by Platfirm AI Pty Ltd

License

Platfirm AI grants you a non-exclusive, non-transferable, revocable, limited license to install and use the CabRank App solely for your internal business operations, in accordance with your selected subscription plan. You may not sublicense, reverse engineer, or otherwise exploit the App beyond the terms of this license.

Agreement and Acceptance

This Agreement is a binding contract between you and Platfirm AI Pty Ltd. By using the App, you affirm that you have read, understood, and accepted these terms. If you are entering into this Agreement on behalf of a company or organization, you represent that you have authority to bind that entity.

Warranty Disclaimer

The App is provided “as is” and “as available” without warranties of any kind. Platfirm AI disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation of the App.

Limitation of Liability

To the maximum extent permitted by law, Platfirm AI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the App, even if we were advised of the possibility of such damages. Total liability shall not exceed the amount paid by you for the App in the 12 months preceding the claim.

Payment Terms

Use of the CabRank App is subject to payment of subscription fees and usage charges as outlined during your onboarding or as amended from time to time. Unless otherwise agreed, all fees are non-refundable and exclusive of applicable taxes. Payment obligations are non-cancellable once a subscription period begins.

Guarantee

We offer no satisfaction guarantee or refund policy, unless required under applicable Australian consumer laws. You are responsible for ensuring the App is suitable for your needs before purchase.

Purchase and Renewal

Purchases of the App are handled via Microsoft AppSource or through direct invoicing by Platfirm AI. Subscriptions automatically renew unless you provide written notice of cancellation at least 30 days before the end of the current term.

Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law provisions. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of courts located in Sydney, NSW.

Changes to Terms

We may update these Terms of Use from time to time. Continued use of the App after changes are posted constitutes acceptance of the revised terms.
